Loss of Your Driver’s License in Virginia after a DWI/DUI

Did you know that when you are arrested for DUI, you will automatically lose your license? This is called an Administrative License Suspension. If your blood alcohol content (BAC) is .08 percent or higher, or you refused to take a chemical test when asked by the officer, he can take your license at the scene. If this is your first offense, your license will be suspended for seven days. If this is your second offense, the suspension will last for 60 days or until your court date (whichever date comes first). The only exception to this is if you were stopped on private property. Then the implied consent law does not apply.
This license suspension is separate from any criminal charges you may be facing. Even for a first offense, you can be sentenced to jail time, expensive fines, mandatory “DUI School,” and a loss of your license for one year. In most cases the judge will grant a restricted license on a first offense.
